City Council Meeting Minutes for 10/30/2009

CITY COUNCIL SPECIAL - Property Purchase (old Renova/LP Mill site)

OPENING  Mayor Hellar called the special session of the city council to order at 8:00 a.m. on Friday, October 30, 2009, in the council chambers at City Hall, 1123 Lake.

ROLL CALL  Council members Boge, Newton, Snedden, Logan, and O’Hara were present.   Councilman Reuter was absent.

RESOLUTION NO. 09-68 ACQUISITION OF PROPERTY – MILLTOWN (RENOVA – LP SITE)

Mayor Hellar announced the purpose of the special meeting was to authorize the mayor to sign the real estate purchase and sale agreement and any other documents or check necessary for the purchase of a portion of real property located on the Milltown Park site for a roundabout.  Public Works Director Kody Van Dyk pointed out to Councilwoman Newton that the property was not appraised, as there were ongoing negotiations between the City of Sandpoint and the property owner.  He noted city council has only requested an appraisal for property the city sells.  He said the portion of property is approximately ¼ of an acre and approximately 1,350 square feet.

Kody Van Dyk replied to Councilwoman Logan that closing costs are shared between the purchaser and seller, but the real estate commission is borne by the seller.  He said the city will not be paying any taxes due.   Planning Director Jeremy Grimm explained language was included in the Purchase and Sale of Real Property that no more than four lots be created by a Short Plat because the property would be used as a travel way.  He said the lot line adjustment does not require a public notice because the property owner owns all adjacent property, and it does not pertain to property owners located within 300 feet from the property.  Kody Van Dyk felt comfortable with the purchase price, as it would be a more efficient use of funds over the long run rather than installing a traffic signal.  He said if the property wasn’t purchased by the city, then a traffic signal or a four way stop with signs would be installed, but he didn’t recommend it.  He didn’t feel a four way stop at the intersection would work.

Councilwoman Logan moved that the proposed resolution, “Acquisition of Property – Milltown (Renova – LP Site)” be approved.  Councilman Boge seconded the motion.  The motion passed unanimously by a roll call vote of council present.

ADJOURNMENT   The meeting adjourned at 8:16 a.m.
